Ashland County issued the following announcement on Sept. 24.
Sealed bids will be received by the Ashland County Commissioners, 110 Cottage Street, Ashland, Ohio 44805 until 9:15 A.M. on Thursday, October 1, 2020, for furnishing all labor, materials, tools and equipment to perform The Ashland County Guardrail Installation and Upgrade Project 2021, in accordance with plans and specifications now on file in the office of the Ashland County Engineer. All material and equipment must meet the specifications and shall include all necessary barricades, signs, lights, watchmen, etc., and work performed shall be under the supervision of the Ashland County Engineer.
Bidders must be listed on the ODOT pre-qualified list for highway construction. Bidders shall submit a list of equipment available, and labor shall be paid not less than the prevailing wage rate as determined by the U.S. Department of Labor for Ashland County. Bidders are hereby notified that federal funds will be used to pay for this improvement. All interested bidders are invited to attend the bid opening which will be held in the Commissioners Public Hearing Room immediately following the 9:15 A.M. deadline.
Specifications, plans and contract documents can be obtained at the office of the Ashland County Engineer, 1511 Cleveland Avenue, Ashland, Ohio 44805, between the hours of 8:00 A.M. and 4 P.M, Monday through Friday.
In accordance with ORC Section 153.54, each bid must be accompanied by a Certified Check or Cashier’s Check or Letter of Credit equal to ten percent (10%) of the amount bid, or a bond for the full amount of the bid as a guarantee that if the bid is accepted, a contract will be entered into and a performance bond properly secured. Bid security furnished in Bond form shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety and shall be to the credit of the Ashland County Commissioners and the Ohio Department of Transportation. The “Bid Guaranty and Contract Bond Instructions” found in the bid documents provides specific instructions with regard to Bid Guarantees and Contract Bonds. Should any bid be rejected, such instrument will be forthwith returned upon proper execution of a contract.
Each bid must contain the full name or names of persons and company submitting the bid and shall be enclosed in an envelope marked “Ashland County Guardrail Installation and Upgrade Project”. Each bidder must submit evidence of its experiences on government projects of similar size and complexity, and a complete listing of all subcontractors to be used. The owner intends and requires that these projects be completed no later than July 30, 2021.
All contractors and subcontractors involved with the project will, to the extent practicable, use Ohio products, materials, services, and labor in the implementation of this project. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123, the Governor’s Executive Order of 1972, and Governor’s Executive Order 84-9 shall be required.
Disadvantaged Business Enterprise Goal is 5%
Bidders must comply with the prevailing wage rates on Public Improvements in Ashland County, Ohio, as determined by the U.S. Department of Labor under Davis-Bacon and related acts.
Ashland County may reject any or all of the bids on any basis and without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim, or cause of action by any unsuccessful bidder against Ashland County. Any exceptions to the specifications are to be included in writing with the bid submitted.

BIDDER'S AFFIDAVIT
Ohio Revised Code sections 3517.13 (I)(3) and 3517.13(J)(3) require that no agency or department of this state or any political subdivision shall enter into any contract for the purchase of goods costing more than five hundred dollars or services costing more than five hundred dollars with a corporation, individual, partnership, or other unincorporated business, association, including, without limitation, a professional association organized under Chapter 1785. of the Revised Code, estate, or trust unless the contract includes a certification that the individuals named in Revised Code sections 3517.13(I)(1) and 3517.13(J)(1) are in compliance with the aforementioned provisions. The offeror is required to complete the following downloadable affidavit form (PDF document).
Failure to submit the required form with the proposal / bid packet will deem the offeror’s response to be non-responsive and disqualified from receiving further consideration.
